Terms of Service
These terms are an agreement between you and Public Figure World LLC ("Public Figure," "we"), which runs publicfigure.world. By making an account, buying or selling, you agree to them. We wrote them to be read, so please do.
1. What Public Figure is
Public Figure is a marketplace where independent sellers list collectible figures, custom figures and figure files, and buyers buy them. Sellers are not our employees or agents. When you buy, your contract for the item is with the seller. We run the site, take payment on the seller's behalf, hold it until the order is done, and step in when something goes wrong.
2. Your account
- You must be at least 18, or the age of majority where you live, to buy or sell. Younger collectors can browse.
- Give us true information and keep it current. One person, one account, unless we agree otherwise.
- You're responsible for everything done with your account. Keep your password private and tell us right away if someone else gets in.
- Usernames and shop names can't impersonate a person, brand or another shop.
3. Buying
- The price you see is the item price plus shipping, plus any sales tax we're required to collect. Buyers pay no extra marketplace fee.
- You pay Public Figure, not the seller. For physical items, the seller is paid when you confirm the order arrived as described, or automatically 21 days after it was marked shipped if you don't confirm or report a problem. For digital files, the seller is paid 3 days after purchase.
- Only confirm delivery once you've checked the item. Confirming releases the payment, and it can't be undone.
- If an item doesn't arrive, isn't as described, or is fake, don't confirm. Message the seller first. If you can't sort it out, contact us before the payment is released and we'll review it. We may refund you, ask you to return the item, or decide the order stands.
- Offers you make are binding if the seller accepts them and you complete checkout in time.
4. Selling
- You can only list items you own and can ship, or files you have the right to sell. Describe them honestly: condition, box, what's included, and real photos of the actual item.
- Official figures must be genuine. Customs must say they're customs. Fan-made pieces and likenesses of real people follow our customs and IP rules, including their labels.
- Ship within the time you promise, with tracking, packed so the item arrives in the condition you described.
- You set your prices. Don't ask buyers to pay outside Public Figure. Sales taken off the site lose buyer protection and can get your shop closed.
- You're responsible for your own taxes, permits and the laws that apply to what you sell and where you ship it, including customs forms for international orders.
5. Fees and payouts
- Listing is free. When something sells, we keep a commission on the item price: 8% as standard. Makers who joined in Wave 1 pay 6% and Wave 2 pay 7% for as long as their shop stays open and in good standing.
- Card processing (2.9% + 30¢ of the order total) is also taken from the sale. Optional extras, like featured listings, are priced where you buy them.
- Payouts go through Stripe. You agree to the Stripe Connected Account Agreement, and Stripe may ask you to verify your identity and bank account. We can't pay you until Stripe has.
- If an order is refunded or charged back after you were paid, we can take that amount back from your future payouts or your Stripe balance.
- We may change fees with at least 30 days' notice. Changes never apply to sales already made.
6. What you can't list or do
- Counterfeits, bootlegs or knockoffs sold as official.
- Anything illegal, stolen or dangerous. Sexually explicit items. Real weapons or parts of them. Items that break someone else's rights.
- Photos you didn't take or don't have the right to use, including stock or store photos used to show an item you're selling.
- Fake reviews, shill bidding or offers, price manipulation, spam, scraping the site, or getting around our fees, limits or moderation.
- Harassing, threatening or deceiving other people.
We review listings, sometimes with automated tools and always with a person behind them. We can refuse, hide or remove any listing, and limit, pause or close any account, if we believe it breaks these terms or puts people at risk. We'll tell you why when we can.
7. Your content
You keep ownership of the photos, descriptions, 3D files and other content you post. You give us a worldwide, non-exclusive, royalty-free license to host, show, copy, resize and share that content to run and promote Public Figure, for as long as it's on the site and for a reasonable time after.
Photos of a catalog figure may also be shown as that figure's reference photo on its catalog page, with credit to your shop. You can ask us to stop at any time.
You promise you have the right to post what you post. If someone owns the rights and tells us it's theirs, we follow the process on our customs and IP page, including counter-notices and our repeat infringer policy. Copyright notices go to ip@publicfigure.world.
8. Our content
The Public Figure name, logo, design, code and catalog data are ours or our licensors'. Brand and character names on the site belong to their owners and are used only to describe items. Their use doesn't mean those owners endorse Public Figure or any seller.
9. Disclaimers
We work to keep the site accurate and running, but it's provided as it is and as available. We don't make or inspect the items sellers list, and we can't promise any item's authenticity, value or condition beyond what our buyer protection covers. Price history and market values are estimates from past sales, not appraisals or financial advice.
10. Limits on our liability
To the fullest extent the law allows, Public Figure isn't liable for indirect, incidental, special or consequential losses, or lost profits, from your use of the site. Our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim, or $100. Some places don't allow these limits, so they may not all apply to you.
If you break these terms or the law and someone makes a claim against us because of it, you'll cover our reasonable costs of dealing with it.
11. Disputes with us
If you have a problem with us, email contact@publicfigure.world first and we'll try to fix it within 30 days. These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute that we can't settle will be decided in the state or federal courts in California, and you and we agree to their jurisdiction. Nothing here limits rights you have under the consumer laws of the place you live.
12. Changes and ending
We may update these terms. If a change is important, we'll tell you by email or on the site at least 14 days before it takes effect. Using Public Figure after that means you accept the new terms. You can close your account any time, once your open orders are finished. We may suspend or close accounts as described above. Sections that by their nature should continue, like fees owed, your content license for past posts, disclaimers and liability limits, continue after an account is closed.
